SMS Consent Process

Tolin & Tolin, PLLC uses text messaging for both service-related communications and, where separately authorized, marketing or promotional communications concerning legal services.

Service-related SMS consent and marketing SMS consent are treated separately.

Service-Related Text Messages

Tolin & Tolin, PLLC may obtain verbal or other affirmative consent from prospective clients, current clients, former clients, or others before sending service-related text messages concerning a legal-services inquiry, intake process, appointment, matter, requested service, account, or other interaction with the Firm.

Service-related messages may include:

  • responses to legal inquiries;
  • intake links;
  • follow-up concerning an inquiry;
  • requests for documents or information;
  • appointment or scheduling information;
  • deadline or reminder messages;
  • matter-related communications;
  • account or client-service notifications;
  • instructions concerning next steps; and
  • other communications related to legal services requested from the Firm.

A person may consent to service-related SMS communications by:

  • verbally agreeing during a telephone conversation;
  • requesting that information be sent by text;
  • providing a mobile number through a Firm intake or contact process and affirmatively agreeing to receive service-related text messages;
  • initiating an SMS exchange with the Firm; or
  • otherwise affirmatively requesting or agreeing to service-related SMS communications.

Verbal Service-Related Consent Script

Before a service-related SMS message is sent following a telephone interaction, the receptionist, attorney, staff member, or AI-assisted receptionist may use substantially the following consent script:

If the person affirmatively agrees, the receptionist, attorney, staff member, or AI-assisted receptionist may confirm:

Thank you. We’ll send the text to this number.

If the person does not affirmatively agree, the Firm does not send service-related SMS messages based on that verbal consent process.

Consent to receive service-related text messages is voluntary.

Marketing and Promotional Text Messages

Marketing or promotional text messages are treated separately from service-related communications.

Marketing messages may include:

  • information about Tolin & Tolin legal services;
  • information about new or expanded Firm services;
  • reminders that the Firm is available to assist with legal matters;
  • educational or service information intended to develop or maintain a business relationship;
  • follow-up with prospective or former clients; and
  • other promotional or business-development communications concerning Firm services.

Consent to receive service-related text messages does not by itself constitute consent to receive marketing or promotional text messages.

Where separate marketing consent is required, Tolin & Tolin obtains affirmative consent specifically authorizing marketing or promotional SMS communications.

For online intake and contact processes, marketing consent may be requested through a separate, optional, unchecked consent control.

The marketing consent language used in the Firm’s intake or contact process may state substantially:

The marketing consent control is not preselected.

Choosing not to consent to marketing or promotional text messages does not prevent a person from:

  • submitting a legal inquiry;
  • completing the Firm’s intake process;
  • obtaining legal services; or
  • separately consenting to service-related SMS communications.

Consent to receive marketing or promotional text messages is voluntary and is not a condition of obtaining or purchasing legal services from Tolin & Tolin, PLLC.

Other Marketing Opt-In Methods

Where appropriately implemented, marketing consent may also be obtained through another documented affirmative method, including:

  • another electronic consent control;
  • a written consent form;
  • an appropriately configured text-message keyword or confirmation process; or
  • another affirmative method satisfying applicable requirements.

The Firm may maintain records showing when, how, and for what type of communications consent was provided.

Opting Out

Recipients may opt out of SMS communications at any time by replying:

After an opt-out request is processed, the Firm may send a final confirmation message acknowledging the request.

Privacy

Tolin & Tolin, PLLC does not sell, rent, or share mobile telephone numbers, SMS opt-in information, or text-message consent information with third parties or affiliates for their own marketing or promotional purposes.

Mobile information and SMS consent information may be provided to telecommunications carriers, messaging providers, software providers, automation providers, artificial-intelligence providers, and other vendors or service providers only as reasonably necessary to operate the Firm’s communications, intake, technology, and messaging systems or otherwise provide services on behalf of the Firm.
